These terms are an agreement between you and Carpooler (“we”, “us”) for your use of ridecarpooler.com (the “Service”). By creating or joining a carpool, or otherwise using the Service, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Service.
What Carpooler is, and isn't
Carpooler is a free scheduling tool. It helps a group of families and drivers who already know each other share driving to an activity: members list their riders and when they can drive, and the Service suggests a driving schedule.
Carpooler does not provide transportation. We don't employ, screen, background-check, license or insure drivers, we don't inspect vehicles, and we aren't a party to any ride. Every ride is an arrangement between the members of a carpool. You're responsible for deciding who you drive with and who drives your riders.
Who can use it
You must be at least 18 years old (or the age of majority where you live) to use the Service. Children may be listed as riders by their parent or guardian, but must not use the Service themselves.
Driver and rider safety
If you drive for a carpool, you agree that you will:
- hold a valid driver's license and the vehicle insurance required where you drive;
- drive safely and obey traffic laws;
- use car seats, booster seats and seat belts that are appropriate for each rider and required by law, and never carry more passengers than you have proper seats for;
- tell the other members promptly if you can't make a scheduled drive.
Parents and guardians are responsible for deciding whether a carpool and its drivers are suitable for their riders, and for confirming each ride with the driver. The schedule is a suggestion based on what members entered: always double-check who is driving and when.
Your account
You sign in through our sign-in provider. Keep your sign-in details secure and don't share your account. You're responsible for what happens in your account, and should tell us right away if you think someone else has used it.
Information you add
- Only add information that's accurate and that you have the right to share, including information about your riders. If you add someone else's information (such as a child's name), you confirm that you're their parent or guardian or have their permission.
- Information you add to a carpool is shown to that carpool's other members, as described in our Privacy Policy. Only share a carpool's join code with people you want in it.
- You keep ownership of what you add. You give us permission to store, display and process it only to run the Service for you and your carpool.
Carpool organizers
The person who creates a carpool is its organizer. Organizers can edit the carpool's details and dates and email its members. Only use these tools for the carpool, and don't send members spam or anything unrelated.
Acceptable use
You agree not to:
- join or try to access a carpool you weren't invited to, or impersonate anyone;
- use other members' information for anything other than the carpool, such as marketing, or harass anyone;
- add false, harmful, unlawful or offensive content;
- interfere with, overload, probe or try to break the Service's security, or access it with bots or automated tools;
- use the Service for any commercial ride service, or to charge for rides.
Emails
By joining a carpool you agree to receive emails about it, such as your welcome summary, updates from the organizer, and monthly schedules if the organizer turns them on. You can unsubscribe from update and monthly emails at any time with the link in each email.
Changes and availability
We may change, pause or stop any part of the Service at any time. The Service relies on outside providers and may occasionally be unavailable or lose information, so keep your own note of important ride arrangements. We may update these terms. If we do, we'll change the date at the top, and if the changes are significant we'll let members know. Continuing to use the Service after changes means you accept them.
Ending your use
You can stop using the Service at any time, leave any carpool from its page, and ask us to delete your information (see our Privacy Policy). We may suspend or remove access, or remove information, if someone breaks these terms or puts others at risk.
Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of fitness for a particular purpose, accuracy or uninterrupted availability. We don't guarantee that schedules are correct or complete, that any member will drive as scheduled, or anything about any member, driver or vehicle.
Limitation of liability
To the fullest extent the law allows, Carpooler and the people who run it are not liable for any indirect, incidental, special or consequential damages, or for any injury, loss or damage arising from rides, from members' conduct, or from your use of or inability to use the Service. Because the Service is free, our total liability for any claim relating to it is limited to $50. Some places don't allow these limits, so they may not fully apply to you.
Your responsibility to us
If you break these terms or the law while using the Service, or a claim arises from rides you give or arrange, you agree to cover the reasonable costs and losses this causes us, to the extent the law allows.
General
These terms are governed by the laws of the United States and of the state where Carpooler is operated, without regard to conflict-of-law rules. If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't given up the right to enforce it later. These terms and our Privacy Policy are the whole agreement between you and us about the Service.
